Kristin Hyman was sworn in during a ceremony at Brennan Courthouse on June 8, Kristin Hyman, 32, was fired in February and last month a Superior Court Civil Division judge tossed the lawsuit she filed against the county with prejudice, which means she cannot reassert that she wa s fired as a result of sexual harassment , gender bias and for being a whistleblower. In dismissing the suit, the judge found, in part, that Hyman had no evidence to back up her claims.
The judge also noted that the investigation into her past began two days before she made her claim of sexual harassment to superiors, negating the whistleblower claim in the lawsuit. The judge also found that a sexual harassment claim against a county attorney could not be considered because her complaint was never amended to include the attorney. But the matter is not dead. Anton, filed an appeal in the Superior Court Appellate Division a week ago and that could take as long as two years before there is a ruling by a panel of judges, said attorney Ralph Lamparello, speaking for the county.
Hyman said she could not comment on the pending litigation when she was reached on Tuesday. Anton could not be reached for comment. As civil service employee, Hyman also filed a lawsuit claiming her termination was unfair and a first hearing in the matter is expected to take place before the end of the year in the Hudson County Superior Court Administrative Law Division.
Lamparello said Tuesday that the county intends to argue in Administrative Law Court that the matter should be dismissed because a Superior Court Civil Division judge had ruled the allegations were without merit. Lamparello said the county will also argue that Hyman cannot make the same allegations in two seperated court venues. Hyman has stated that those were acting roles.
Hyman was fired shortly after she was sworn in with the rest of her class of rookies at a ceremony in the Justice William J. Brennan Jr. Courthouse in Jersey City. Hudson County Sheriff Frank Schillari also said he had no comment on the pending litigation.
