Those moments of remorse will likely carry no weight during Mazzaglia's murder trial, which kicks into full gear today when the jurors are sworn in at noon. Mazzaglia's comments are part of an hour interview that has been mostly suppressed by the court because Mazzaglia, 31, of Dover, was not read his Miranda rights, or the right to remain silent, in a timely manner.
Mazzaglia said he and the two year-old women played a game of strip poker and bondage, domination and sadomasochism BDSM sex came up in the conversation between them. Mazzaglia and McDonough participated in BDSM on a regular basis, using knives, ropes and leather restraints during sex. Mazzaglia told police on a couple of occasions, a third person joined them.
On Bondage. In an affidavit for Mazzaglia's arrest submitted to the court by Pettingill, the detective writes that Mazzaglia told them he did not render Marriott any aid. During a time when he was not sure of whether Marriott was dead or not, Mazzaglia placed a plastic grocery bag over her heard. During the interview, Mazzaglia also led police to Peirce Island in Portsmouth where he and McDonough reportedly threw Marriott's body, wearing nothing but thong style underwear and some jewelry, into the water.
Physical evidence collected at Peirce Island, including hair and pearl-like beads, will be admissible in court because it was determined by Judge Kenneth Brown after a February evidentiary hearing that they would have inevitably been discovered.
Women's clothing, a pair of men's underwear, a used condom, a condom wrapper and two pairs of gloves were found in a dumpster outside Mazzaglia's apartment and will also be admissible as evidence. The jurors will visit the grounds of the Sawyer Mill apartment complex where Mazzaglia lived and the location on Peirce Island where he and McDonough are said to have dumped Marriott's body into the Piscataqua River during their view on Tuesday afternoon.
